2. Music License & Ownership

Your custom song is created specifically for you and your story. You receive a personal-use license to enjoy and share your song on your personal social media (Instagram, Facebook, TikTok) and privately with family and friends. Gift A.I Tunes retains ownership of the music to protect the artists, youth creators, and community programs supported by this fundraiser. The song may not be sold, used commercially, or uploaded to music streaming platforms (Spotify, Apple Music, YouTube Music, etc.).

2a. Personal Use Rights

You are free to: Play your song at personal events (birthdays, weddings, celebrations), share privately with family and friends, post on personal social media accounts with proper attribution to Gift A.I Tunes, and create personal videos featuring your song for non-commercial purposes.

2b. Prohibited Uses

You may not: Sell, license, or distribute the song commercially, upload to streaming platforms (Spotify, Apple Music, YouTube Music, Amazon Music, etc.), use in commercial advertising or promotional materials, claim ownership or copyright of the song, or modify the song for commercial distribution.

3. Disclaimer

The materials on Gift A.I Tunes are provided on an 'as is' basis. Gift A.I Tunes makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Fundraiser & Final Sales

Gift A.I Tunes operates as a charitable fundraising initiative. Because this is a custom fundraising project, all sales are final and non-refundable. Your purchase helps fund youth training, STEAM education, special needs programs, and community support initiatives. Every song purchased directly contributes to these programs.

5. Accuracy of Materials

The materials appearing on Gift A.I Tunes could include technical, typographical, or photographic errors. Gift A.I Tunes does not warrant that any of the materials on its website are accurate, complete, or current.

Gift A.I Tunes has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Gift A.I Tunes of the site. Use of any such linked website is at the user's own risk.

Music Licensing and Large Venue Requirements

Songs created through Gift A.I Tunes are licensed for personal use in private settings. If you intend to use the song in large public or semi-public venues such as weddings, birthday celebrations, memorial services, or graduation ceremonies with multiple guests, you must purchase the corresponding Large Venue Add-On to ensure compliance with music licensing laws.

The Large Venue Add-On covers public performance rights for group listening settings, expanded audience coverage for ceremonies and celebrations, and compliance with ASCAP, BMI, and SESAC licensing requirements. Failure to obtain the appropriate add-on for large venue use may result in copyright infringement claims.
